These Terms of Use and End User Licence Agreement (“Terms”) govern your use of the Pass Your Test mobile application (“App”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

References to “we”, “us”, or “our” mean Learn to Drive Pro LTD.
References to “you” or “user” mean any person using the App.

1. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the App. If you are under 18, you confirm that you have obtained consent from a parent or legal guardian.

2. Description of the App

The App provides educational content designed to assist learner drivers, including 3D animated videos and voiceover explanations of driving scenarios.

The App offers:

  • limited free content; and
  • paid access to additional content via in-app purchases or subscriptions.

The App is for educational purposes only and does not constitute professional driving instruction or guarantee any test outcome.

3. Licence Grant and Restrictions

3.1 Licence

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and use the App and its content solely for personal, non-commercial use on a device you own or control.

3.2 Restrictions

You must not, except where permitted by law:

  • copy, reproduce, distribute, transmit, or publicly display the App or its content;
  • use the content outside the App without our prior written permission;
  • modify, reverse engineer, decompile, or attempt to extract source code;
  • exploit the App or content for commercial purposes;
  • circumvent technical protection measures.

All rights not expressly granted are reserved.

4. Intellectual Property

All intellectual property rights in the App and its content (including videos, animations, audio, text, graphics, and software) are owned by or licensed to Learn to Drive Pro LTD and are protected by applicable intellectual property laws.

Unauthorised use is strictly prohibited.

5. Payments, Subscriptions, and In-App Purchases

5.1 Platform Billing

Paid features are offered through Apple App Store or Google Play in-app purchases or subscriptions. Payments are processed by Apple or Google, not by us.

5.2 Subscription Terms

Where subscriptions are offered:

  • subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period;
  • you can manage or cancel subscriptions through your Apple ID or Google Play account settings;
  • any unused portion of a free trial is forfeited when a subscription is purchased.

5.3 Refunds

Refunds are subject to Apple’s or Google’s policies. We do not provide refunds directly.

6. User Responsibilities

You agree to use the App lawfully and in accordance with these Terms. You must not:

  • misuse the App;
  • interfere with its operation or security;
  • use the App in a way that infringes the rights of others.

We may suspend or terminate your access if you breach these Terms.

7. Disclaimer of Warranties

To the maximum extent permitted by law, the App and its content are provided “as is” and “as available”, without warranties of any kind, whether express or implied.

We do not warrant that:

  • the App will be uninterrupted or error-free;
  • the content is complete, accurate, or suitable for any particular purpose;
  • use of the App will result in passing any driving test.

8. Limitation of Liability

To the fullest extent permitted by law, Learn to Drive Pro LTD shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the App.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence or fraud.

9. Educational Disclaimer

The App is a learning tool only. Driving competence depends on multiple factors, including professional instruction and individual ability. We make no guarantee of outcomes or test success.

10. Third-Party Services and Platform Terms

Your use of the App may also be subject to the terms and policies of Apple Inc. or Google LLC.

Apple-Specific Acknowledgement

You acknowledge that:

  • these Terms are concluded between you and Learn to Drive Pro LTD, not Apple;
  • Apple is not responsible for the App or its content;
  • Apple has no obligation to provide maintenance or support;
  • Apple is not responsible for addressing claims relating to the App;
  • Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them.

Google-Specific Acknowledgement

You acknowledge that Google is not responsible for the App or its content, and that your use of Google Play services is governed by Google’s terms.

11. Termination

We may terminate or suspend your access to the App at any time if you violate these Terms or if required by law. Upon termination, your licence to use the App will immediately cease.

12. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect and use personal data.

13. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be made available within the App or on our website. Continued use of the App constitutes acceptance of the updated Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
